Licensing Terms

I. License

  1. By submitting an author's work – an article (hereinafter referred to as the "Work") for consideration for publication in the Chemické listy journal (hereinafter referred to as the "Journal"), the author consents to the publication of the Work in the printed and electronic version of the Journal and grants Česká společnost chemická, z.s. (hereinafter referred to as the "Publisher") a license to use the Work under the conditions specified below.
  2. The license is granted as a non-exclusive license; the author is entitled to exercise the economic rights to the Work. For further use of the Work, the author agrees to acknowledge the Journal as the source.
  3. The author grants the Publisher a license to all known uses of the Work; in particular, to reproduce the Work and to communicate the Work to the public. The Publisher is entitled to use the Work separately, in a collection or connection with any other copyrighted work or elements.
  4. The territorial scope of the license granted by the author is unlimited.
  5. The author grants a license to the Work for the duration of the economic rights to the Work.
  6. The author grants a license to the Work gratuitously.
  7. The Publisher is entitled to include the published Work in the information systems and bibliographic databases of his choice (e.g. Web of Science, Scopus, EBSCO).
  8. The Publisher is entitled to sub-license the use of the Work to other persons within the scope of the license granted by the author. The Publisher is entitled to grant a sub-licence for a remuneration or gratuitously.
  9. The Publisher is not obliged to use the licence granted by the author.

II. Auhor's Declaration

  1. The author declares that they are the genuine author of the Work and that they are entitled to use the Work within the scope of the license granted. The Work is free from legal defects and, within the scope of the licence granted, the author's right to use the Work is not limited by the rights of third parties, e.g. grant providers.
  2. The author declares that the Work has not been published anywhere else and that it has not been offered to another publisher simultaneously as the Work is sent to the Publisher to consider its publication.
  3. If the Work is a work for hire under Section 58 of the Act No. 121/2000 Coll., on Copyright and Rights Related to Copyright and on Amendment to Certain Acts (Copyright Act), as amended, the Author declares that they are entitled to license such Work in accordance with Article I.
  4. If the Work has more than one author, the author declares that all co-authors have been informed of the contents of these licensing terms and have agreed to the publication of the Work in the Journal and that the Author has licensed the use of the Work to the Publisher on their behalf in accordance with Article I of these licensing terms.
  5. The author agrees that the Creative Commons BY 4.0 International (CC BY 4.0 International) license, available at: https://creativecommons.org/licenses/by/4.0/legalcode, will be attached to the Work on their behalf. This license authorizes users to share the Work through any medium in any format and to adapt the Work, even commercially. However, for any use, the user is required to cite the author’s name, the title of the Work, the source and the license.
  6. The author acknowledges that in the event that any of their declarations prove to be false, they shall be liable for damages resulting from such false declarations.

III. Governing Law

  1. In the event of a dispute arising out of violation of these licensing terms, the governing law is Czech law.
  2. Courts of the Czech republic have jurisdiction to settle any disputes arising out of violation of these licensing terms.

IV. Open Access Declaration

  1. The Publisher hereby declares that the Journal is published as an open access journal, i.e. a journal that allows immediate, free, permanent and free access to the articles published in it.
